Juvenile Crimes / Juvenile Delinquency

Juvenile Crimes / Juvenile Delinquency:

Any parent with a child in trouble should hire a juvenile attorney.  In Michigan, juvenile criminal charges are those that are brought against minors that are less than 17 years old.  When a parent has a child that is facing juvenile charges or a “delinquency action”, as they are also referred to in Michigan, it is essential that they receive the professional representation they needed. Juvenile charges can be as serious as adult charges and without a knowledgeable attorney or team of attorneys, the effects of the charge(s) concerning your child can be long-lasting, expensive, and heavy handed.

If your son or daughter has a delinquency action pending, and you would like to speak to an attorney or to retain, Garmo & Kiste, PLC call us at (248) 398-7100 for a free consultation or contact us with a private message.

Juvenile Acts of Delinquency

Juvenile acts of delinquency fall under “status crimes” or “criminal crimes”, but all juvenile crimes are serious. Juvenile delinquency and status offenses are handled by the Family Court Division of the Circuit Court in the County in which the action occurred.  If your child is found guilty of an offense, they could be taken into state custody and thus it is essential to have a juvenile attorney at your child’s side.

The Role of a Juvenile Attorney

Possibly the biggest challenge, and the most important role of your juvenile attorney is to keep your child’s case from entering the adult court.  For serious crimes committed by minors which are 14 years or older the Court may “waiver” the case into the adult court.  Being tried in the adult court can be harmful to your child as Adult Court cases may be made public, while the Juvenile Court generally keeps all records confidential.  What this means for your child is they may be facing a much graver impact should they be found guilty, including the creation of a permanent criminal record, a stiffer sentence and higher fines.

If your son or daughter has a Juvenile case pending, we recommend that you retain experienced counsel to aid in the defense of this charge.  We know the law and can help you understand your child’s rights and develop defenses to the charges levied against your child.
